ABOUT NC REAL ESTATE

North Carolina is one of a handful of states that uses a 'Due Diligence' style Offer to Purchase and Contract (OTP). There are no contingencies in an NC OTP; real estate is sold As-Is, in its current condition. 

Sellers will receive a non-refundable due diligence (DD) deposit from the buyers at contract acceptance which gives the buyers the right to 'do all due diligence,' including conducting inspections, securing financing, and reviewing any pertinent information before deciding whether or not they want to move forward with the purchase.

During this period, there are often negotiations between the buyer and seller based on the results of the information discovered during the DD period. Sellers are not obligated to make any changes or concessions, but buyers have the right to walk away for any reason (or no reason) during the DD period.

There is a second Earnest Money (EM) deposit paid to the attorney at contract acceptance; it is refundable until 5pm at the end of DD. After DD ends, the EM becomes non refundable and the deposits are credited toward the purchase price at closing.
